ORDINANCE NO. 93-746

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY

OF TEMPLE CITY ADDING SECTIONS 4280 AND 4281

TO THE TEMPLE CITY MUNICIPAL CODE RELATING

TO AEROSOL SPRAY PAINT AND MARKING PEN REGULATIONS 

WHEREAS,           the City Council has determined that the proliferation of graffiti vandalism within the City of Temple City and throughout the San Gabriel Valley is a matter of great public concern; and 

WHEREAS,           graffiti vandalism has resulted in the destruction of public and private property; and 

WHEREAS,           it is known that acts of graffiti vandalism are frequently committed by juveniles; and 

WHEREAS,           aerosol spray paint and marking pens are commonly used to committed by juveniles; and 

WHEREAS,           certain measures can be implemented to reduce the occurrence of graffiti vandalism 

THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY ORDAIN AS FOLLOWS: 

SECTION 1.           Article IV, Chapter of the Temple City Municipal Code is hereby amendd by dding Part VIII, Sections 4280 and 4281 to read as follows:

It shall be unlawful for any person to sell, exchange, give, loan or cause or permit to be sold, exchanged, given or loaned, any pressurized can or other container commonly known as an aerosol spray paint can, marking pen, or container which contains paint or dye to anyone under the age of eighteen (18) years.  It shall be unlawful for anyone under the age of eighteen (18) years to purchase or otherwise obtain any
